1. Agreement

The agreement is formed when America Bus Reservation Corporation (DBA Europe Bus Reservation) (EBR) accepts a booking.

A written acceptance of a quotation will be deemed a booking.

This agreement will be upon the terms set out within these terms and conditions.

Only variations or amendments made in writing by America Bus Reservation Corporation (DBA Europe Bus Reservation) will be considered to take precedence over these terms.

Any attempted changes made either verbally or in writing by the Customer will be disregarded.

The Customer shall notify America Bus Reservation Corporation (DBA Europe Bus Reservation) within 7 days of any concerns they may have regarding these terms and conditions.

Definitions: "Customer" refers to the person or entity making the booking, "Services" means the transport services provided, "Vehicle" means the coach or minibus supplied, and "Force Majeure" includes events beyond reasonable control such as strikes, weather, pandemics, flight or train delays.

These terms apply to all contracts, whether verbal or written, and exclude any terms implied by the Customer or by laws such as the Supply of Goods and Services Act 1982 (except where non-excludable).

The contract is formed only by EBR's written booking confirmation, constituting the entire agreement and superseding any prior discussions.

The Customer acts on behalf of all passengers and is responsible for their actions.

The customer must ensure that all details are correct in the booking confirmation email such as dates, itinerary, vehicle size, number of pax before processing the payment as the booking information can only be changed subject to extra costs.

2. Services

The Customer must ensure that:

Passengers maintain a high standard of behaviour and comply with the driver’s instructions.

No interruptions or delays occur that may endanger the driver, passengers, or breach statutory regulations.

Pick-up times are respected; delays may incur extra costs payable to the operator.

The correct number of seats and appropriate vehicle size (including luggage requirements) are selected.

Food or alcohol is not consumed without prior written consent.

All vehicles are non-smoking.

Animals are not carried without written consent.

No posters or notices are displayed on the vehicle without consent.

Routes are at the operator’s discretion unless agreed in writing.

The Customer has the emergency and driver’s contact numbers at all times.

Where EBR arranges third-party services (ferries, accommodation, meals, tickets), the Customer is bound by those suppliers’ conditions.

Prohibited items include weapons, explosives, illegal drugs, alcohol, perishable, inflammable, or corrosive goods. The driver may refuse or remove them at their discretion.

EBR provides the services with reasonable care and skill but may substitute an equivalent operator or vehicle without liability.

The Customer indemnifies EBR for any damage, vandalism, or cleaning costs caused by passengers, payable immediately.

For persons with reduced mobility (PRM), the Customer must verify accessibility requirements, including child car seats, in advance.

The Customer ensures compliance with seatbelts and safety standards; EBR is not liable for injuries due to non-compliance.

Customer is responsible to check whether the provided addresse(s) are accessible by the requested vehicle size.

3. Vehicles

Vehicles are supplied by partners and comply with Euro 5/6 standards, but may be substituted without notice.

EBR's liability for lost or stolen luggage is limited to £500; the Customer is responsible for valuables, with lost items held for 1 month.

The Customer is responsible for overloads, with the driver having the right to refuse excess weight or size.

4. Driving Hours and Rest Periods

All services comply with EU Regulation (EC) No 1073/2009. Driver hours and rest periods are regulated by law.

Driving limits include a maximum of 9 hours per day (extendable to 10 hours under conditions), with a 45-minute break after 4.5 hours, and rest periods of 11 hours daily, as per Regulation (EC) No 561/2006.

The Customer indemnifies EBR for any costs or fines due to passenger-caused delays, with the right to terminate the service immediately.

EBR is not responsible for delays due to external factors such as traffic, weather, flight or train delays.

5. Payment Policy & Price

The price for services included will be set out on the invoice and booking confirmation.

Any additional charges that may be incurred on the day of travel will be directly payable to America Bus Reservation Corporation (DBA Europe Bus Reservation) by the Customer.

Example additional costs but not limited to: Extra mileage, driver accommodation and meals, parking charges, road tolls, Value Added Tax and Sales Duty Tax.

For bookings within 30 days of departure, full payment is required.

Otherwise: 50% deposit upon reservation, balance 30 days before departure.

Delays in payment may result in cancellation; cancellation fees still apply.

Card storage policy: The card details entered can be stored so that subsequent transactions related to the booking or additional costs and services, in relation with our payment or cancellation policy, do not require you to enter your card details.

Overdue payments accrue interest at 6% above the Bank of England base rate, with EBR reserving the right to suspend or cancel services.

Prices exclude VAT and taxes unless stated, and EBR may apply surcharges for unforeseen costs (e.g., fuel or currency fluctuations) if notified more than 30 days in advance.

Card storage complies with GDPR, with details used only for related transactions and with customer consent.

6. Cancellation Policy

Free cancellation for 12h after your booking confirmation (applicable if date of departure is in more than 10 days after the date of the booking confirmation).

In case of cancellation: 30 days or more before the date of departure, a charge equivalent to 25% of the total order value is due to America Bus Reservation Corporation (DBA Europe Bus Reservation).

In case of cancellation: 15–29 days before the date of departure, a charge equivalent to 50% of the total order value is due to America Bus Reservation Corporation (DBA Europe Bus Reservation).

In case of cancellation: 08–14 days before the date of departure, a charge equivalent to 75% of the total order value is due to America Bus Reservation Corporation (DBA Europe Bus Reservation).

In case of cancellation: 01–07 days before the date of departure, a charge equivalent to 100% of the total order value is due to America Bus Reservation Corporation (DBA Europe Bus Reservation).

No-show or same-day cancellations incur 100% charges; modifications may incur fees (e.g., $50 if less than 7 days before).

Refunds exclude non-refundable third-party services, and EBR is not liable for operator cancellations beyond sourcing alternatives.

7. Travel Insurance

America Bus Reservation Corporation (DBA Europe Bus Reservation) ensure that all Coach Partners, providing transport services on its behalf, have the required insurances relative to Passenger Transport service.

EBR is not liable for personal losses (e.g., luggage, injuries due to customer fault); customers are advised to obtain their own travel insurance.

EBR's insurance covers public liability only and excludes consequential losses.

8. Force Majeure

EBR shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to strikes, civil commotion, weather, pandemics, flight or train delays.

9. Limitation of Liability

EBR’s total liability is capped at 100% of the charges paid; EBR excludes liability for indirect or consequential losses (e.g., loss of profits, goodwill). Maximum liability for lost luggage is $500.

10. Intellectual Property & Data Protection

America Bus Reservation Corporation (DBA Europe Bus Reservation) owns all intellectual property arising from the services; the Customer grants EBR a license to use materials provided. The Customer ensures consents for data transfer under GDPR and indemnifies EBR for breaches.

11. Termination

EBR may terminate and/or alter the booking for breach or non-payment, with survival of liability and indemnity clauses.

12. Governing Law, Jurisdiction & Arbitration

These terms are governed by the laws of the State of New York, USA. The courts of New York, USA have exclusive jurisdiction. In addition, EBR may elect to refer disputes to international arbitration under the ICC or LCIA rules, in New York, USA, with proceedings conducted in English. Arbitration awards shall be final and binding.
